Terms of Service

AutomotivEye is an AI-powered automotive advisory tool operated by smaltsoft. It retrieves and analyzes publicly available vehicle data to assist with car buying decisions, diagnostics, and pricing.

The service is provided "as is" and "as available." AI responses are non-deterministic and may contain errors or inaccuracies. smaltsoft is not liable for any decisions made based on AutomotivEye's outputs. Always verify critical information — including pricing, recalls, and specifications — with official sources before making decisions.

You must be at least 18 years old to create an account. You agree to provide accurate and complete information during registration and to keep your credentials secure.

You are responsible for all activity that occurs under your account. Notify us immediately at automotiveye@smaltsoft.com if you suspect unauthorized access.

Free Plan: 2 conversations, up to 4 messages per conversation.

Pro Plan: unlimited conversations, generous message limits, best AI model, and priority performance.

Current pricing is available at automotiveye.com/pricing. smaltsoft reserves the right to change plan features or pricing with reasonable notice.

Pro subscriptions are billed monthly (€17.99) or annually (€179) through Stripe. Your subscription renews automatically at the end of each billing period until canceled.

smaltsoft never stores your payment card details. All payments are processed securely by Stripe, Inc.

You may cancel your Pro subscription at any time from your account settings. You retain Pro access until the end of the current billing period. No partial refunds are issued for unused time.

We do not offer refunds. By subscribing to a Pro plan, you explicitly request immediate access to digital content and acknowledge that you waive your 14-day right of withdrawal under EU Directive 2011/83/EU, as the digital service is fully delivered upon payment.

You may not use AutomotivEye to:

— Violate any applicable law or regulation. — Scrape, copy, or redistribute service content. — Attempt to reverse-engineer, interfere with, or harm the service or its infrastructure. — Submit false, misleading, abusive, or harmful content. — Use the service for commercial resale or API access without authorization.

The service is provided without warranties of any kind, express or implied, including fitness for a particular purpose or merchantability.

smaltsoft is not liable for any indirect, incidental, special, or consequential damages — including lost profits, data loss, or harm resulting from reliance on AI-generated responses — even if advised of the possibility of such damages.

Our total liability for any claim arising from use of the service is limited to the amount paid by you to smaltsoft in the three months preceding the claim.

These Terms are governed by the law of the Republic of Poland and applicable EU regulations.

Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Poland.

EU consumers retain all statutory rights granted under applicable EU consumer protection legislation, which these Terms do not limit.
